Sales Board Guidelines: Supplemental Provisions and Definitions
Sales Board User Agreement
Pre-owned and worn
TimeZone limits for sale, want to buy and want to trade ads to pre-owned watches that have been worn. Pre-owned means sold to, unwrapped (i.e. protective flims removed) and worn by a retail customer, and no open papers. Your ad must establish that your watch is both pre-owned and has been worn. If your ad does not provide this information, we may contact you to request proof that our requirements are met, or we may remove your ad without notice, at our discretion. You may not list or seek watches that are new, New In Box (NIB), Brand New in Box (BNIB), factory fresh, still in the plastic, or similar. Please see the TZ Grading System below for the grades we allow. TimeZone sponsors may offer new watches for which they are authorized agents. If you may not list your watch here, please visit the Trading Post at Watchnet.com.
Community members may buy, sell and trade new watch-related items such as straps, bracelets, winders, tools, books, and boxes.
Please note that TimeZone does not permit the sale of items which the seller does not possess but which he intends to acquire after a sale has been arranged.
papers
Please do not use TimeZone sales boards to buy, sell or trade warranty documents, booklets, or cards, receipts, COSC certificates, or other documents intended by the manufacturer to accompany a specific watch, unless you also seek or offer the related watch. Do not list or seek "open papers." You may list or seek instruction manuals.
3 per day
3 posts per day means 3 posts per person,
company, store, business, or other organization, enterprise or
association. For example, two people in business together may
post a total of 3 ads.
Links and references
Please do not include in your post any links or references to auction sites, specific auctions, or to commercial sites. Links include but are not limited to text, images and icons. References include but are not limited to full or partial auction site names, and complete and some partial URLs. For example, if you have a site at www.sellawatch.com, you may watermark images using your name, but not sellawatch, a logo stating "sellawatch", sellawatch.com or any other more complete version of the URL. You may also not use photos containing materials or props that show the link or URL to a commercial site. Do not say "currently available on [auction site name]." You may not use TZ sales boards to directly or indirectly refer or direct people to an auction posted elsewhere. You may post links to image hosting sites and to personal web pages where images of the item in your ad are hosted, so long as the sites/pages linked to only host images and do not offer watches for sale.
"Want to Buy"
You may post a WTB ad only if you are a
private buyer seeking to purchase one example of a specific used
watch for your personal use, and not for re-sale. You may not
post an ad seeking multiple examples of a specific watch model.
"blanket discount"
TimeZone sales boards are limited to ads for specific items at specific prices.
Accordingly, we do not allow ads offering discounts
on more than one example or style of watch or other item. For
example, you may not post an ad that reads "20% off all
Movado"; "50 assorted straps at 30% off"; or "One Concord
at 25% off, others available." Sales board ads should identify the item(s)
being offered with specificity, and state prices in dollars and cents.
"counterfeit or replica watches or parts"
You may not post any fake, counterfeit or replica watch, or any watch that contains
any counterfeit or replica parts. This includes, for example,
a genuine Rolex with an "aftermarket" bracelet that
bears the Rolex crown logo, or a genuine Rolex with an aftermarket
Rolex dial that bears the Rolex name or logo. You may not post any items containing a manufacturer's logo which were not specifically produced or authorized by that manufacturer.
"altered"
Do not list any watch that has been altered
to create a watch that appears to be a brand or model it is not.
This includes re-dialed or recased watches, and any other use
of components from different models. This rule applies whether
such changes are disclosed in the ad or not.
By way of example:
You may list a Rolex that has been redialed,
but you may not list a Tudor Sub redialed to look like a Rolex
Sub.
You may list a recased Patek pocket watch,
but you may not list a watch with a Patek case and dial, but
an ETA movement.
You may list an Omega Seamaster Pro that
has an Admiral's Cup bezel added
You may not list an Omega that has been
re-dialed or put together to look like a vintage Seamaster 300.
Grading system
Please keep in mind that to be listed on a TimeZone sales board, a watch must be pre-owned and have been worn. Pre-owned means sold to a retail customer and no open papers.
LNIB
A pre-owned watch that has been worn, yet is in perfect condition. Accompanied by the factory box(es), tags and documentation. No alterations from factory-delivered condition. The warranty papers must be stamped to establish the authenticity and validity of the watch - TimeZone does not allow sales of watches with "open papers." No bracelet resizing or marks of any kind. 100%
Mint
A pre-owned watch that is in very nearly perfect condition. Signs of wear are visible with a low powered loupe. May be a watch that is in LNIB condition but not accompanied by the factory box(es) or documentation. May refer to an older watch that has been restored, so long as the restoration returned the watch to very nearly perfect factory original condition. Working perfectly, keeping excellent time, needs nothing. 98-100%
Near Mint
Showing very light signs of wear. Faint scratches on the case, bezel, bracelet or buckle are visible to the naked eye. Completely original in every way. Strap shows light use - may be bent or lightly creased, but not stained. Bracelet may be resized. The watch is working perfectly, keeping very good time and needs nothing. 93-97%
Excellent
Evidence of use is visible to the unaided eye. Scratches are light, but more numerous than "near mint". If the watch has been restored, all original replacement parts have been used. Strap clearly used but no stains. No dents or dings are detectable, and the bracelet has little wear. Working perfectly, needs no repair or service. 88-92%
Very good
The watch shows what might be considered
normal wear by a careful owner who wore the watch regularly.
Scratches are evident, but no nicks or dings. May have replacement
parts and/or a high quality redial. Running and keeping good
time, though may need minor regulation. A sound, attractive presentation
overall. 83-87%
Good
Nothing fundamentally wrong with the watch,
though it has quite obviously been used. Running and wearable,
but may gain or lose a few minutes over 24 hours. Case may
show a few dings, nicks, or deep scratches. May have a redial
that is not up to high standards. May not have all original parts.
77-82%
Fair
Well used, may require service and/or restoration
to be useable. May be running erratically. Dial,
case, and other major components may not be original, but no
pieces are missing. Even an untrained eye could tell the watch
is worse for wear. Some might call it rough. 72-76%
Poor
Shows abuse, requires service and/or restoration.
May have major cosmetic flaws, missing parts, may not run at
all. A speculative piece - 'fixer-upper' would be too generous.
Not junk, but requires lots of work to be made wearable. 66-71%
Scrap / Parts
A collection of parts that at one time
may have been a functioning timekeeper. Now missing parts, may
be rusted or corroded, not worth restoring. Most people would
call it junk. 64% or worse.
Your watch description must expressly state one of the grades set out above, or an intermediate grade. If your watch does not fall precisely into
one of the grades, you may use an intermediate indication
such as "Good +" and provide a description of why an intermediate grade was used, for example
"cosmetically rough, but just received a full mechanical
overhaul, new strap, and runs perfectly."
Caveat emptor
TimeZone's sales boards are online message
boards for our community members to buy, sell, and trade among themselves. All TimeZone sales board transactions are undertaken at your own risk. TimeZone
is not involved in the transaction between the parties,
and TimeZone does not actively screen buyers, sellers, or items
offered for sale or trade. As a result, TimeZone has no control
over the authenticity or quality of the items advertised, the
truth or accuracy of the descriptions, the ability or intent of sellers
to deliver items, or the ability or intent of buyers to pay for items. Parties to transactions should make a copy
of the ad for their records. TimeZone cannot guaranty
that ads will be available at a later date.
We cannot ensure that a buyer or seller will actually complete
a transaction. Be aware of the risk that funds will be transferred and goods will not be sent in exchange.
TimeZone is unable to verify the actual identity or location of
buyers or sellers. Buyers are urged to take reasonable precautions to assure their seller is trustworthy - please review our Tips for Avoiding Fraud for more information.
TimeZone urges caution in all long-distance
transactions with persons unknown to you, especially if a deal
seems "too good to be true."
TimeZone urges parties to communicate via telephone before agreeing to buy, sell or trade in order to establish the trustworthiness of the other party, that
the item is as described, and that all terms
are understood and agreed by both sides. Some of the points buyers and seller should clarify include:
Condition
Does the item require service? If it's a watch, is it running
well and keeping good time? Does the seller know the history?
Has it been repaired or had parts replaced? Does it come with
original box and papers? Can the seller provide additional pictures
to verify claims?
ReferencesDoes the buyer want to check the seller's
references? Can buyer verify that the references are genuine, and
not somehow related to or controlled by the seller?
Escrow serviceAn escrow service acts as an agent of
the buyer and the seller. Buyer sends the escrow agent the payment, Seller
sends the escrow agent a box, and when it has both the box
and the payment, the escrow service sends the box to the Buyer
and the money to the Seller. Escrow companies charge a fee for
their service, however they do not usually guaranty the parties will receive the actual item promised. For example, Seller's box might contain a rock and not a watch. The escrow company will not open the box to verify the contents. Using an escrow service is no guarantee of a safe transaction. Also note that there are many phony escrow companies out there.
Shipping methodWho pays shipping and insurance? You
should always insure valuable items being shipped.
Inspection or return periodWill seller allow the watch
to be returned? If yes, for what period of time, and for what
reasons? Is the return privilege unconditional? Only if the watch
is "not as described"? How will you resolve a "damaged
in transit" situation? When does the return period begin
to run? How must buyer notify seller if buyer wants to return
the item? Who pays return shipping? Buyers should keep in mind that in a return situation,
the seller will wind up with your money and with the watch back
in their possession. Make sure your seller is trustworthy!
Duty, tax, or import restriction issuesDuties may be due on goods shipped across national borders. Import restriction issues may arise if you are trying to import a Rolex into the USA. There are also some restrictions on certain watch straps made from animal skins. Buyers
are urged to do further research on these issues to determine the amount of any duty or tax that may be due, and to ensure the item they are buying can be shipped into their country.
Contact InformationParties to transactions should get the other party's mailing address (a fixed address, not a post office box) and
a telephone number in the event you need to contact the Seller
at a later date. Verify all information provided.
User Agreement
By using TimeZone.com you hereby agree as follows.

Guidelines, TZ Showcase Guidelines, Sales Board Supplemental Guidelines, and Tips for Avoiding Fraud are hereby incorporated by reference.
Compliance with Law
All users shall comply with all applicable domestic
and international laws, statutes, ordinances and regulations
regarding your use of our site and your listing, purchase, solicitation
of offers to purchase, and sale of items.
No Agency
Use of TimeZone.com sales boards does not create any agency, partnership,
joint venture, employee-employer or franchiser-franchisee relationship
between TimeZone, its owner, officers, directors, agents, affiliates,
contractors, and employees, and you.
RELEASE
In the event of any dispute between you and any other user(s),
you release TimeZone and its owner, officers, directors, agents,
affiliates, contractors, and employees from claims, demands and
damages (actual and consequential) of every kind and nature,
known and unknown, suspected and unsuspected, disclosed and undisclosed,
arising out of or in any way connected with such disputes. If
you are a California resident, you agree to waive California
Civil Code §1542, which says: "A general release does
not extend to claims which the creditor does not know or suspect
to exist in his favor at the time of executing the release, which
if known by him must have materially affected his settlement
with the debtor."
LIMITATION OF LIABILITY. IN NO EVENT
SHALL WE BE LIABLE FOR LOST PROFITS OR ANY SPECIAL,INCIDENTAL
OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH
OUR SITE,(HOWEVER ARISING, INCLUDING NEGLIGENCE). OUR LIABILITY
TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO
$100.Some States do not allow
the exclusion or limitation of incidental or consequential damages,
so the above limitation or exclusion may not apply to you.
NO WARRANTY. WE PROVIDE OUR WEB SITE
"AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS,
IMPLIED OR STATUTORY. WE SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES
OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND
NON-INFRINGEMENT. Some states do
not allow the disclaimer of implied warranties, so the foregoing
disclaimer may not apply to you. This warranty gives you specific
legal rights and you may also have other legal rights that vary
from state to state.
Indemnity
You agree to indemnify and hold us and (as applicable) our owner,
affiliates, officers, directors, agents, contractors, and employees,
harmless from any claim or demand, including reasonable attorneys'
fees, made by any third party due to or arising out of your breach
of this Agreement or the documents it incorporates by reference,
or your violation of any law or the rights of a third party.
Disputes
Resolution of Disputes. In the event a dispute arises between you and TimeZone, you and and TimeZone agree that any claim or controversy at law or equity that arises out of this User Agreement or your participation on TimeZone.com ("Claims") shall be resolved in accordance with one of the 3 numbered paragraphs below or as otherwise mutually agreed by the parties in writing. Before resorting to these alternatives, we ask that you to first contact TimeZone to seek a resolution and we will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation, as an alternative to litigation.
1. Binding Arbitration. For any Claim (excluding Claims for injunctive or other equitable relief) where the total amount of the award sought is less than $10,000, you or TimeZone may elect to resolve the dispute through binding arbitration conducted by telephone, on-line and/or through written submissions where no in-person appearance is required. In such cases, the arbitration shall be administered by the American Arbitration Association or JAMS in accordance with their rules, or any other established Alternative Dispute Resolution provider mutually agreed upon by the parties. Any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
2. Court. Alternatively, any Claim may be adjudicated by a court of competent jurisdiction located in Los Angeles County, California or where the defendant is located (for TimeZone, Torrance, California, and for you, your home address or principal place of business). You and TimeZone agree to submit to the personal jurisdiction of the courts located within the county of Los Angeles, California.
3. Alternative Dispute Resolution. Alternatively, TimeZone will consider use of other forms of dispute resolution such as binding arbitration to be held in Los Angeles County, California or another location mutually agreed to by the parties.
All Claims except requests for injunctive or equitable relief must be resolved using the dispute resolution mechanism that is selected in accordance with the three numbered paragraphs above by the first party to file a Claim. Should either party file an action contrary to this Disputes section, the other party may recover attorneys' fees and costs up to $1500, provided that the party seeking the award has notified the other party in writing of the improperly filed Claim, and the other party has failed to withdraw the Claim.
Miscellaneous
This Agreement shall be governed by the laws of the State of
California. We do not guaranty continuous, uninterrupted access
to our site. If any provision of this Agreement is found to be
invalid or unenforceable, such provision shall be struck and
the remaining provisions shall be enforced. Headings are descriptive
only and do not define, limit, or otherwise affect the scope
or extent of each section. Our failure to act with respect to
a breach by you or others does not waive our right to act with
respect to subsequent or similar breaches. This Agreement sets
forth the entire understanding and agreement between us with
respect to the subject matter hereof.
Modification
We reserve the right to amend this agreement from time to time
without notice.
Revocation of posting privileges
TimeZone.com is a privately owned, semi-private, conditional use website. Violation of TimeZone guidelines or user agreement can result in the revocation of posting privileges on both TimeZone and Watchnet with or without formal notice. TimeZone reserves the right to remove or edit any post with or without notice and to revoke the posting privileges of any person or entity on TimeZone, Watchnet, or both, either temporarily or permanently. Revocations are within the sole discretion of TimeZone.com management and are not subject to appeal or challenge. Revocations apply regardless of user, screen or entity name. Suspended users may not post or otherwise participate on TimeZone either directly or indirectly through entities, fictitious names, third parties, or otherwise. Posting for or on behalf of a suspended user is grounds for revocation of posting privileges. Continued participation on TimeZone.com by a suspended user may constitute a trespass, a violation of the user's ISP rules, or other civil and/or criminal violation(s), and TimeZone.com reserves the right to pursue any and all remedies against such violators, to report the matter to the user's ISP(s), and to refer such matters to local, state, and/or federal authorities, or to international authorities and authorities in the user's home country.
